IMPORTANT NOTICE

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING OUR TUTORING SERVICES. THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING DISCLAIMERS, LIABILITY LIMITATIONS, AND DISPUTE RESOLUTION CLAUSES. BY BOOKING, PAYING FOR, OR PARTICIPATING IN OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY RIGHTS YOU MAY HAVE UNDER THE AUSTRALIAN CONSUMER LAW THAT CANNOT BE EXCLUDED.

1. About These Terms

1.1 These Terms of Service (“Terms”) govern your use of medical admissions tutoring services provided by Farhan Uddin (ABN 36 788 419 671), a sole trader operating in Victoria, Australia (“we,” “our,” “us,” or “Farhan”).

1.2 By booking, paying for, or participating in our services, you agree to be bound by these Terms.

1.3 We provide services to students located in Australia and overseas who are applying to Australian medical and dental schools.

1.4 These Terms incorporate and should be read together with our Privacy Policy, available at www.farhanuddin.com.au.

2. Key Definitions

  • “Customer”: The person who enters into this agreement with us, pays for the services, and is legally responsible for all fees and compliance with these Terms.
  • “Student” or “Participant”: The individual receiving tutoring and related services. The Student may also be the Customer if 18 years or older.
  • “Parent/Guardian”: A person with legal responsibility for a Student who is under 18.
  • “Services”: All tutoring services we provide, including individual sessions, the Medical Interview Acceptance Accelerator, group sessions, resources, and any future subscription or membership services.

Where the Student is under 18, references to “you” or “your” in relation to payment obligations mean the Parent/Guardian as Customer.

3. Eligibility and Age Requirements

3.1 Our paid Services are designed for Students aged 16 and above.

3.2 If the Student is under 18, the Parent/Guardian must:

  • Act as the Customer; and
  • Read, understand, and agree to these Terms; and
  • Be the person who completes payment and ticks “I agree to the Terms of Service”.

3.3 By paying for Services and ticking “I agree”, you represent and warrant that:

  • You are at least 18 years old; and
  • If the Student is under 18, you are their Parent/Guardian and have authority to bind them to these Terms.

3.4 You warrant that all information you provide is true, accurate, and not misleading.

4. Service Descriptions

4.1 Individual Tutoring Sessions

  • One-on-one medical admissions tutoring via video call (e.g. Zoom/Google Meet).
  • Customised preparation for Australian medical/dental school applications, interviews, and entrance tests.
  • Session-specific materials and resources may be provided.

4.2 Medical Interview Acceptance Accelerator

  • Comprehensive interview preparation program with conditional guarantee and “if you don't get in, you don't pay” structure, as detailed in Section 6.
  • Includes multiple one-on-one sessions, mini-mock interviews, and exclusive resources.
  • Deposit and success-fee payment structure for the Pay Later Plan.
  • Specific completion requirements for guarantee eligibility.

4.3 Group Sessions

  • Small group tutoring sessions (when available).
  • Shared learning environment with multiple Students.
  • Cost-effective alternative to individual sessions.

4.4 Future Subscription / Membership Services

  • Ongoing access to resources and/or regular sessions.
  • Monthly or annual subscription options.
  • Automatic renewal unless cancelled in accordance with the then-current subscription terms.

5. Payment Terms

5.1 General

  • All fees are in Australian Dollars (AUD).
  • Payment methods: Stripe or other approved processors.
  • Payment confirmation is required before service delivery.
  • Receipts are provided by email.

5.2 Individual Sessions

  • Payment is due in full before the scheduled session.
  • If you are unable to attend at all (with appropriate notice under Section 7), a full refund is provided.

5.3 Medical Interview Acceptance Accelerator – Pricing Options

Option 1 – Prepay Plan

  • Cost: $4,995 AUD paid upfront.
  • Benefits: Priority scheduling and immediate program access.
  • Guarantee: Conditional success guarantee in Section 6 (you may choose a full refund or future credit if conditions are met and you do not receive an offer).

Option 2 – Pay Later Plan

  • Initial deposit: $45 AUD to secure program place.
  • Success fee: $6,495 AUD payable only upon receiving an offer to any Australian medical or dental school, subject to Section 6.
  • Total potential cost if successful: $6,540 AUD.
  • Guarantee: Conditional success guarantee in Section 6 (you may choose a full refund of amounts paid or a future credit if conditions are met and no offer is received).

5.4 Upgrade from Pay Later to Prepay

  • You may upgrade from the Pay Later Plan to the Prepay Plan any time before you sit your first interview.
  • After you have sat your first interview, the upgrade option is no longer available and the Pay Later pricing is locked in.
  • Your $45 deposit is credited toward the $4,995 Prepay cost (additional $4,950 payable on upgrade).
  • Priority scheduling begins immediately upon upgrade.

5.5 Parent/Guardian Agreement

By selecting any pricing option and completing payment, the Customer (including any Parent/Guardian) agrees to all associated payment obligations, including the success fee where applicable.

6. Guarantees (Medical Interview Acceptance Accelerator Only)

6.1 Marketing Phrases and Legal Effect

Any marketing phrases such as “guaranteed acceptance” or “if you don't get in, you don't pay” are shorthand for the conditional guarantee, payment terms, and refund/credit options set out in this Section 6. We do not and cannot guarantee admission to any medical or dental school.

Nothing in this Section limits any rights you may have under the Australian Consumer Law.

6.2 7-Day On-Ramp Guarantee

  • You may request a 100% refund within 7 days of program commencement if unsatisfied.
  • Eligibility: Only available if, at the time of request, there are 28 or more days remaining until the Student's first scheduled interview. Students with fewer than 28 days until their first interview are not eligible.
  • No reasons required. Refund is processed within 14 business days.
  • Upon refund, access to all program materials is revoked.
  • This guarantee applies once per Student and cannot be combined with the conditional success guarantee.

6.3 Conditional Success Guarantee

Applies to both Prepay and Pay Later Plans.

If you:

  • Complete all required conditions in Section 6.4; and
  • Do not receive an offer from any Australian medical or dental school,

then you may choose either:

  • (a) a full refund of all amounts paid; or
  • (b) a credit for the same program in a future interview round.

For the Prepay Plan, a full refund means refund of $4,995. For the Pay Later Plan, a full refund means refund of the $45 deposit; no success fee will be payable.

6.4 Required Conditions

To qualify for the conditional success guarantee (refund or credit), the Student must:

  1. Complete 2 live mini-mock interviews with Farhan; and
  2. Attend at least 5 one-on-one sessions with Farhan (including mini-mocks); and
  3. Complete the Interview Stories worksheet with personal examples for each topic.

We maintain records to verify session attendance and worksheet completion.

6.5 Proof of Application Result

  • You must provide acceptable proof of all application outcomes within 30 days of receiving the final results.
  • Acceptable proof includes: official offer letters or rejection notifications, or screenshots, from VTAC, UAC, SATAC, QTAC, TISC, or other relevant bodies.

6.6 Success Fee Trigger (Pay Later Plan Only)

  • The $6,495 success fee becomes payable when you receive an offer to study medicine or dentistry at any Australian institution, regardless of whether you accept that offer.
  • Payment terms: success fee payable within 14 days of the date you receive your first such offer.

6.7 Communication Requirements

  • You must maintain reasonable communication throughout the application and results period.
  • You must promptly notify us of application results (acceptance or rejection) within 14 days of receiving them.
  • You must keep your contact details up to date and respond to our communications within 7 days.

6.8 Loss of Contact Presumption (Pay Later Plan Only)

This clause applies only to Customers on the Pay Later Plan.

If, during the medical school offer period (typically October–February), we cannot reach you or the Student after reasonable efforts, we may presume that an offer has been received and that the success fee is due, subject to the rebuttal process below.

Reasonable efforts include at least:

  • 3 separate email attempts over a period of at least 21 days; and
  • 2 SMS and/or phone call attempts to the last provided mobile numbers.

At least one email will clearly state that if you do not respond within 60 days with proof of rejection from all applied schools, we may treat the Student as having received an offer and charge the success fee.

Rebuttal Period: You have 60 days from our final contact attempt (as stated in that email) to provide documented proof of rejection from all applied schools. If you do so, the success fee will not be charged.

If you do not respond within that time and do not provide proof of rejection, we may treat the Student as having received an offer and charge the $6,495 success fee in accordance with these Terms.

Nothing in this clause removes any rights you may have under the Australian Consumer Law.

6.9 Exclusions from Conditional Guarantee

You are not eligible for a conditional guarantee refund or credit if you:

  • Do not complete all required conditions in Section 6.4; or
  • Cancel the package before completion; or
  • Withdraw from the medical/dental application process; or
  • Fail to provide acceptable proof of application results within the timeframe; or
  • Breach these Terms in a material way; or
  • Have already used the 7-day On-Ramp Guarantee for that program round.

6.10 Off-Boarding Call

We strongly encourage all Students to attend a brief off-boarding call at the end of the application cycle to review outcomes and feedback. This is an expectation, not a condition of any guarantee, refund, or credit.

7. Cancellation and Rescheduling

7.1 Individual Sessions – Student Cancellations

  • 24+ hours' notice: Session rescheduled at no charge.
  • Less than 24 hours' notice: Session is forfeited, no refund.
  • No-show: One no-show may be rescheduled at our discretion; subsequent no-shows are forfeited.
  • Unable to attend at all (for reasons communicated sufficiently in advance): Full refund provided.

7.2 Individual Sessions – Tutor Cancellations

  • We will provide as much notice as reasonably possible.
  • The session will be rescheduled to a mutually convenient time.
  • Any payments made will be credited toward the rescheduled session.
  • If cancellation at very short notice causes significant inconvenience, we may offer reasonable additional compensation at our discretion.

7.3 Medical Interview Acceptance Accelerator

  • Student rescheduling: Unlimited rescheduling with reasonable notice, subject to calendar availability.
  • Package cancellation after program commencement voids all guarantee rights except where required by law.
  • No partial refunds for incomplete packages unless required by the Australian Consumer Law.

7.4 Group Sessions

  • 48 hours' notice required for full refund.
  • Rescheduling is subject to group availability and feasibility.

8. Materials, Intellectual Property, and Recordings

8.1 Proprietary Materials

  • All tutoring materials, study guides, question banks, worksheets, videos, manuals, and other content (“Materials”) are owned by Farhan Uddin.
  • You receive a limited, non-transferable licence to use the Materials solely for the Student's personal educational purposes.

8.2 Restrictions

You must not:

  • Copy, distribute, share, sell, or publicly display our Materials; or
  • Share our Materials with anyone outside the Student's immediate family, whether paid or unpaid; or
  • Use our Materials to create competing products or services.

Violation may result in:

  • Immediate termination of services;
  • Forfeiture of any refunds; and/or
  • Legal action for intellectual property infringement.

8.3 Session Recordings – Educational Use

  • With your explicit consent, we may record tutoring sessions for educational purposes (e.g. Student review, internal training, quality assurance).
  • Recordings remain our property and are typically stored for up to 1 year.
  • You may request access to recordings of your own sessions for personal study; we may provide this at our discretion.

8.4 Session Recordings & Testimonials – Marketing Use

  • We may from time to time request additional, specific consent to use your name, image, voice, academic results, feedback, or session excerpts as testimonials or marketing content (e.g. on our website, social media, or marketing emails).
  • We will not use identifiable session snippets or academic scores in marketing without your separate, explicit consent.
  • Refusing marketing consent does not affect your access to the Services.
  • Where consent is given, you grant us a non-exclusive, worldwide, royalty-free licence to use such content for marketing and promotional purposes, which you may revoke in writing for future use.

9. Student Responsibilities

9.1 Preparation and Engagement

  • Attend sessions punctually.
  • Complete agreed work between sessions.
  • Participate actively and respectfully.
  • Maintain regular communication regarding scheduling and progress.

9.2 Academic Integrity

  • Provide accurate information about academic background and goals.
  • Ensure personal statements and application materials reflect the Student's own voice and experiences.
  • Do not request or expect us to write application materials on your behalf.

9.3 Technical Requirements

  • Maintain a stable internet connection and suitable device.
  • Ensure access to Zoom/Google Meet and the ability to receive digital materials.
  • Promptly report technical issues that affect sessions.

10. Our Responsibilities and Disclaimers

10.1 Service Delivery

We will:

  • Provide high-quality, professional tutoring services;
  • Draw upon experience in medical admissions preparation;
  • Provide up-to-date, relevant guidance and resources.

10.2 Important Disclaimers

  • We do not and cannot guarantee admission to any medical or dental school.
  • Outcomes depend on many factors beyond our control, including academic performance, competition, interview performance, and institutional preferences.
  • We are not responsible for changes to admission requirements, processes, or institutional policies.

10.3 Scope Limitations

  • Our role is advisory; all final application decisions remain yours.
  • We do not provide legal or medical advice.
  • We are independent and not affiliated with any university, medical school, or admissions body.

11. Termination

11.1 Termination by Student

  • Individual sessions: No ongoing commitment; you may simply stop booking.
  • Packages: Early termination forfeits guarantee and refund rights except as required by law.

11.2 Termination by Us

We may terminate or suspend Services if:

  • You breach these Terms;
  • You engage in disruptive, abusive, or inappropriate behaviour;
  • You fail to pay fees when due;
  • You share proprietary Materials without permission; or
  • You engage in academic dishonesty.

On termination:

  • Services cease immediately;
  • No further sessions will be delivered;
  • Any outstanding fees remain payable;
  • Refund rights are limited to those required by law or expressly stated in these Terms.

11.3 Survival

Payment obligations, intellectual property provisions, limitations of liability, dispute resolution terms, and other provisions that by nature should survive termination will continue in effect.

12. Liability Limitations

12.1 Disclaimer of Warranties

Except as required by law or expressly stated in these Terms, Services are provided “as is” and “as available”, without any warranties, express or implied.

12.2 Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for all claims arising out of or relating to the Services is limited to the amount you paid for the Services in the 12 months preceding the claim; and
  • We are not liable for any indirect, consequential, or special loss, including lost opportunities, loss of chance, or emotional distress.

12.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law that cannot be excluded, restricted, or modified.

13. Fair Use Policy (Medical Interview Acceptance Accelerator)

13.1 Unlimited Sessions Framework

“Unlimited sessions” means sessions within reasonable fair use parameters that allow effective learning without burnout or abuse of the Service.

13.2 Session Cadence

  • Standard period: Maximum 3 sessions per week up until 14 days before the first scheduled interview.
  • Final sprint: During the 14 days immediately before each interview, daily sessions may be booked (subject to availability).
  • A minimum of 24 hours is required between sessions unless we agree otherwise.

13.3 Booking Requirements

  • Sessions must be booked with at least 24 hours' notice where reasonably possible.
  • Emergency or last-minute sessions may be accommodated at our discretion.

13.4 Fair Use Breaches

If we reasonably believe you are attempting to use sessions in a way that is excessive, abusive, or not aligned with effective preparation, we may:

  • Decline or reschedule session requests;
  • Discuss more effective study strategies; and in extreme cases
  • Terminate the program without refund, subject to your rights under the Australian Consumer Law.

13.5 Multiple Interviews

If you have interviews at multiple institutions, the “final sprint” window applies separately for each interview, subject to proof of interview dates.

14. Dispute Resolution

14.1 Informal Resolution

If you have concerns or a complaint, you agree to first contact us at farhan@farhanuddin.com.au and allow us at least 30 days to attempt to resolve the matter informally, which may include partial or full refunds, credits, or other resolutions.

14.2 Arbitration and Other Avenues

To the extent permitted by law:

  • Disputes that cannot be resolved informally may be referred to arbitration in Victoria, Australia, conducted in English by a single arbitrator.
  • This does not prevent you from bringing a claim in a consumer tribunal or small claims court where you are entitled to do so under applicable law; or exercising any non-excludable rights under the Australian Consumer Law.

15. General Provisions

15.1 Governing Law

These Terms are governed by the laws of Victoria, Australia, and, where applicable, the laws of the Commonwealth of Australia.

15.2 Modifications

We may update these Terms from time to time. Material changes will be notified via our website and/or email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15.3 Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Where possible, the invalid provision will be modified to the minimum extent necessary to be valid and enforceable.

15.4 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Services and supersede all prior understandings.

15.5 Assignment

We may assign or transfer our rights and obligations under these Terms. You may not assign your rights without our prior written consent.

15.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, technical failures, or similar events.

15.7 Communications and Newsletter

By providing your email, you consent to receive essential service-related communications (e.g. scheduling, billing, program updates). You may also be added to our educational email newsletter. You can unsubscribe from non-essential marketing emails at any time by using the unsubscribe link or contacting us. See our Privacy Policy for details.

17. Acknowledgment and Acceptance

By booking, paying for, or participating in our Services, you acknowledge that:

  • You have read and understood these Terms;
  • You agree to be legally bound by them;
  • You understand the guarantee conditions, success fee obligations, and refund/credit options;
  • You accept the dispute resolution framework; and
  • You understand the limitations and disclaimers regarding outcomes and liability.

These Terms are effective from the “Last updated” date above and govern all Services provided from that date onward.
