PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING OUR TUTORING SERVICES. THESE TERMS CONTAIN IMPORTANT PROVISIONS INCLUDING DISCLAIMERS, LIABILITY LIMITATIONS, AND MANDATORY ARBITRATION CLAUSES. BY BOOKING, PAYING FOR, OR PARTICIPATING IN OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

1. About These Terms

These Terms of Service ("Terms") govern your use of medical admissions tutoring services provided by ‘Farhan Uddin’ ("we," "our," "us," or "Farhan"). By booking, paying for, or participating in our services, you ("Student," "you," or "your") agree to these Terms.
Who We Are: ‘Farhan Uddin’ is a medical admissions tutoring service operating in Victoria, Australia, specializing in preparing students for Australian medical and dental school applications.
Services Covered: These Terms apply to all our tutoring services including individual sessions, Medical Interview Intensive packages, group sessions, and future subscription-based services.

2. Eligibility and Age Requirements
Minimum Age: Our services are designed for students aged 16 and above. Students under 18 require parental consent to use our services.
Parental Consent: If you are under 18, your parent or legal guardian must read, understand, and agree to these Terms on your behalf. By paying for services, parents/guardians agree to all terms including payment obligations.
Capacity: You represent that you have the legal capacity to enter into these Terms and that all information provided is accurate and truthful.

3. Service Descriptions

3.1 Individual Tutoring Sessions
- One-on-one medical admissions tutoring via video call (Zoom/Google Meet)
- Customized preparation for medical school applications, interviews, and entrance tests
- Session-specific materials and resources provided

3.2 Medical Interview Acceptance Accelerator
- Comprehensive interview preparation program with conditional guarantee
- Includes multiple one-on-one sessions, mini-mock interviews, and exclusive resources
- Deposit and success-fee payment structure
- Specific completion requirements for guarantee eligibility

3.3 Group Sessions
- Small group tutoring sessions (when available)
- Shared learning environment with multiple students
- Cost-effective alternative to individual sessions

3.4 Future Subscription Services
- Ongoing access to resources and regular sessions
- Monthly or annual subscription options
- Automatic renewal unless cancelled

4. Payment Terms
Option 1 - Prepay Plan
Cost Structure: One upfront payment
Benefits: Priority scheduling and immediate program access
Guarantee: 100% refund if not accepted and conditional guarantee requirements met

Option 2 - Pay Later Plan:
Initial Cost: Deposit to secure program place
Success Fee: Fee payable only upon acceptance to any Australian medical/dental school
Guarantee: 100% refund if not accepted and conditional guarantee requirements met

Upgrade Option:
Pay Later: Customers may upgrade to Prepay Plan at any time
Any deposit automatically credits towards your upgrade
Priority scheduling activated immediately upon upgrade

Parental Agreement: By selecting either option, parents/guardians agree to all associated payment obligations including success fees where applicable

4.3 Payment Processing
- All payments processed securely through Stripe
- Payment confirmation required before service delivery
- Receipts provided via email for all transactions

5. Guarantees (Medical Interview Acceptance Accelerator Only)
5.1 7-Day On-Ramp Guarantee
Trial Period: Within 7 days of program commencement, you may request a 100% refund if unsatisfied with the service
No Questions Asked: Full refund processed within 14 business days
Program Materials: All materials must be returned/access revoked upon refund request
One-Time Offer: This guarantee applies once per student and cannot be combined with conditional guarantee

5.2 Conditional Success Guarantee
Both Pricing Options: This guarantee applies to both Prepay Plan and Pay Later Plan
Guarantee Promise: If you complete ALL required conditions AND do not receive an offer from any Australian medical or dental school, we will provide a 100% refund

5.3 Required Conditions (Simplified)
To be eligible for the conditional guarantee refund, you must complete ALL of the following:
1. Perform 2x live mini-mock interviews with Farhan
2. Attend 5+ one-on-one sessions with Farhan (including mini-mocks)
3. Complete the Interview Stories worksheet with personal examples for each topic
Verification:
All conditions are trackable and verifiable through our comprehensive records system

5.4 Proof of Application Result
Acceptable Proof: Screenshot or official letter of acceptance/rejection from VTAC, UAC, SATAC, QTAC, or TISC
Deadline: Proof must be provided within 30 days of receiving your application results

5.5 Success Fee Trigger (Pay Later Plan Only)
Success Fee Due: Upon receiving an offer letter from ANY Australian medical or dental school
Payment Terms: Success fee payable within 14 days of offer letter receipt. Fee amount included in website at time of purchase.
No Exceptions: Success fee applies regardless of whether you accept the offer

5.6 Guarantee Exclusions
You are NOT eligible for conditional guarantee refund if you:

Fail to complete ALL required conditions
- Cancel the package before completion
- Withdraw from the medical school application process
- Fail to provide acceptable proof of application results
- Breach any terms of this agreement
- Have already claimed the 7-day satisfaction guarantee

5.7 Communication Requirements
Ongoing Contact: You must maintain reasonable communication throughout the application period and results period
Results Notification: You must promptly notify us of your application results (acceptance or rejection) within 14 days of receiving them
Contact Information: You must keep your contact information current and respond to our communications within 7 days

5.8 Loss of Contact Presumption (Pay Later Plan Only)
Applies To: This presumption applies only to students on the Pay Later Plan
Communication Attempts: If we cannot contact you or your parent/guardian after reasonable attempts during results season, we will make contact attempts via:
- Email (minimum 3 attempts over 21 days)
- Phone/SMS (minimum 2 attempts)
- Any other contact methods provided

Presumption of Success: If we cannot establish contact after these attempts during the medical school offer period (typically October-February), it will be presumed that you received an offer to study medicine or dentistry
Success Fee Due: The success fee becomes immediately payable based on this presumption
Rebuttal Period: You have 60 days from our final contact attempt to provide documented proof of rejection from all applied schools to rebut this presumption

Prepay Plan: Students on the Prepay Plan have already fulfilled their payment obligations and are not subject to this presumption

5.9 Condition Disputes
Verification Process: All conditions are trackable and verifiable through our records
Dispute Resolution: If you dispute meeting the conditions, you must provide undeniable proof of completion
Final Decision: Our records and documentation serve as the primary evidence of condition completion

6. Cancellation and Rescheduling
6.1 Individual Sessions
Student Cancellations:

No-show: Session rescheduled once; subsequent no-shows forfeit session
- Unable to attend at all: Full refund provided
Tutor Cancellations:
-
We will provide as much notice as possible
- Session will be rescheduled to a mutually convenient time
- Any payments made will be credited toward the rescheduled session
- Additional compensation provided if short notice causes significant inconvenience

6.2 Medical Interview Acceptance Accelerator
Student Rescheduling: Unlimited rescheduling allowed with reasonable notice
Package Cancellation: Cancellation after program commencement voids all refund eligibility
Partial Completion: No partial refunds for incomplete packages

6.3 Group Sessions
Cancellation: 48 hours notice required for full refund
Rescheduling: Subject to group availability and consensus

7. Materials and Intellectual Property
7.1 Proprietary Materials
Our Content: All tutoring materials, practice tests, study guides, video recordings, worksheets, and educational content are proprietary to ‘Farhan Uddin’
Student Access: Materials provided for your personal educational use only
Restrictions: You may not copy, distribute, share, sell, or reproduce our materials in any form

7.2 Sharing Prohibitions
Strict Policy: Sharing our materials with anyone outside your immediate family is strictly prohibited
Consequences: Violation results in:
- Immediate termination of services
- Forfeiture of all refund rights
- Potential legal action for intellectual property infringement

7.3 Session Recordings
Ownership: All session recordings remain the property of ‘Farhan Uddin’
Storage: Recordings stored for 1 year when consent provided
Student Access: You may request copies of your recordings for personal review
Consent Required: Recording only occurs with explicit student consent8. Student Responsibilities

8.1 Preparation and Engagement
Attendance: Arrive punctually for all scheduled sessions
Preparation: Complete assigned work between sessions
Participation: Engage actively and professionally during sessions
Communication: Provide timely responses to requests and scheduling communications

8.2 Academic Integrity
Honest Representation: Provide accurate information about your academic background and goals
Original Work: Ensure all personal statements and application materials represent your authentic voice
Ethical Conduct: Maintain the highest standards of academic and personal integrity

8.3 Technical Requirements
Internet Connection: Maintain stable internet connection for video sessions
Platform Access: Ensure access to Zoom/Google Meet and ability to receive materials
Technical Issues: Report technical problems promptly to minimize session disruption

9. Our Responsibilities and Disclaimers
9.1 Service Delivery
Professional Standards: Provide high-quality, professional tutoring services
Expertise: Draw upon extensive experience in medical admissions preparation
Resources: Provide comprehensive, up-to-date materials and guidance

9.2 Important Disclaimers
No Admission Guarantees: We cannot guarantee admission to any medical or dental school
Individual Results: Outcomes depend on multiple factors beyond our control including academic performance, competition levels, and institutional preferences
Application Success: Success depends significantly on your effort, preparation, and application quality
External Factors: We are not responsible for changes to admission requirements, processes, or institutional policies

9.3 Scope Limitations
Advisory Role: We provide guidance and preparation; final application decisions remain yours
Not Legal/Medical Advice: Our services are educational; we do not provide legal or medical advice
Institution Independence: We are not affiliated with any medical or dental schools

10. Termination
10.1 Termination by Student
Individual Sessions: No ongoing commitment; book as needed
Package Programs: Early termination forfeits all refund rights
Notice: Written notice preferred but not required for individual sessions

10.2 Termination by Us
Grounds for Termination:

Breach of these Terms
- Disruptive or inappropriate behavior
- Failure to make required payments
- Sharing of proprietary materials
- Academic dishonesty or integrity violations

Effect of Termination:

Immediate cessation of services
- No refunds for terminated students
- Continued obligation for any outstanding payments

10.3 Survival of Terms
Continuing Obligations: Payment obligations, intellectual property restrictions, and arbitration clauses survive termination

11. Liability Limitations
11.1 Disclaimer of Warranties
AS-IS BASIS: Services provided "as is" without warranties of any kind
NO GUARANTEES: Except for the specific conditional guarantee outlined in Section 5, we make no guarantees about outcomes
BEST EFFORTS: We commit to providing our best professional efforts but cannot control external factors

11.2 Limitation of Liability
MAXIMUM LIABILITY: Our total liability to you shall not exceed the amount you paid for services in the 12 months preceding the claim
EXCLUDED DAMAGES: We are not liable for indirect, consequential, or punitive damages including lost opportunities or emotional distress
APPLICATION OUTCOMES: We specifically disclaim liability for medical school admission decisions

11.3 Acknowledgment
Student Acknowledgment: You acknowledge that admission to medical school depends on many factors beyond tutoring services and that no service can guarantee admission

12. Fair Use Policy (Medical Interview Intensive Package)

12.1 Unlimited Sessions Framework
Service Promise: The Medical Interview Intensive Package includes unlimited one-on-one sessions within the fair use parameters outlined below
Educational Approach: This policy ensures optimal learning spacing and prevents burnout while maximizing preparation effectiveness

12.2 Session Cadence Limits
Standard Period: Maximum 3 sessions per week until 14 days before your scheduled interview(s)
Final Sprint Window: Up-to-daily sessions permitted during the 14-day period immediately preceding your interview(s)
Rationale: Research shows spaced learning is more effective than intensive cramming, except during final preparation phases

12.3 Booking Requirements
Minimum Gap: 24 hours required between consecutive sessions
Scheduling Notice: Sessions must be booked with reasonable advance notice (minimum 24 hours preferred)
Emergency Sessions: Exceptions may be made for urgent preparation needs at our discretion

12.4 Fair Use Violations
Policy Breaches: Attempting to book sessions in violation of these limits may result in:
- Declined booking requests
- Counseling on effective study practices
Good Faith Standard: This policy operates on good faith - we trust students to use sessions constructively rather than attempting to circumvent limits

12.5 Interview Timeline Flexibility
Multiple Interviews: If you have interviews at different institutions, the "final sprint window" applies separately to each interview
Timeline Changes: If interview dates change, the fair use periods adjust accordingly

13. Dispute Resolution and Arbitration
13.1 Mandatory Arbitration
BINDING ARBITRATION: All disputes arising from these Terms or our services must be resolved through binding arbitration
WAIVER OF RIGHTS: You waive your right to trial by jury and participation in class action lawsuits
Individual Basis: All disputes must be resolved on an individual basis

13.2 Arbitration Process
Jurisdiction: Arbitration conducted in Victoria, Australia
Rules: Governed by Victorian arbitration laws and procedures
Arbitrator: Single arbitrator mutually agreed upon or appointed by relevant arbitration authority
Language: Proceedings conducted in English

13.3 Informal Resolution
Required First Step: Before initiating arbitration, parties must attempt good faith resolution through direct communication
Notice Period: Written notice of dispute with 30-day resolution period required before arbitration

13.4 Exceptions
Injunctive Relief: We may seek injunctive relief in court for intellectual property violations or material breaches
Small Claims: Disputes under the small claims court threshold may be pursued in appropriate Victorian courts

14. General Provisions
14.1 Governing Law
Victorian Law: These Terms governed by the laws of Victoria, Australia
Jurisdiction: Subject to arbitration clause, Victorian courts have jurisdiction over any legal proceedings

14.2 Modifications
Updates: We may update these Terms with reasonable notice
Notification: Material changes communicated via email or website posting
Continued Use: Continued use of services constitutes acceptance of modified Terms

14.3 Severability
Invalid Provisions: If any provision is deemed invalid, remaining provisions continue in full force
Reformation: Invalid provisions modified to minimum extent necessary to become enforceable

14.4 Entire Agreement
Complete Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement
Supersedes: Replaces all previous agreements or understandings regarding our services

14.5 Assignment
Our Rights: We may assign our rights and obligations under these Terms
Your Rights: You may not assign your rights without our written consent

14.6 Force Majeure
Excused Performance: Neither party liable for delays or failures due to circumstances beyond reasonable control
